Grandfather and Toddler: An Accident !!

As I was talking about in class, the following information is about the cruise incident. “The grandfather accused of dropping toddler Chloe Weigand from the 11th deck of a Royal Caribbean cruise ship made his first court appearance on Wednesday as Puerto Rican prosecutors insisted it was their 'duty' to charge him with negligent homicide. Salvatore 'Sam' Anello faces three years in prison if he's found guilty of causing Chloe's death by lifting her towards an open window before she tumbled from the Freedom of the Seas while it docked in San Juan on July 7.”
Personally, I do not think he should be found guilty for the event. He was an old man trying to do something nice for his granddaughter. He had no intention of hurting or harming her. This man should not be in prison. He is a man who made a terrible, terrible mistake. He will have to live with the mistake he made, but he should not have to do in jail. 

This also ties into the idea of prison reform. A man such as this grandfather should not be in prison. However, he will be. Prison should be for those true “criminals.” This grandfather is nothing more than a make who had an accident, a true accident. Accidents happen all the time. This tragic event was an accident! His family needs to realize this!

I agree with Lindsey this incident is completely tragic and terrible. I also agree that this was an accident and that the man is already in so much pain because of what accidentally happened and that he will feel this guilt for the rest of his life. But on the other hand, I can see the point of putting him in jail. Although it was an accident, he ultimately did do this and someone died because of it. I feel that if he wasn't sentenced to prison, that there would be a lot of backlash. I mean think of this little girl's parents. I can't even imagine how they feel. They are probably so divided, and sad, and mad all at the same time. Also, I believe if he didn't go to jail a lot of people would see this as "unfair." I think outsiders/others would see it as "someone getting away with murder." This is a tough situation and a very tragic accident.

I would argue that this man should certainly be prosecuted and charged because of his actions. Though it was not his intention he unmistakably caused this child's death. Negligent homicide is a specific charge which entails unintentionally putting someone into a dangerous situation which results in their death. Although this man's story is certainly tragic, he deserves to be punished for his actions. He placed the child in his care into an open window and though he never intended her to get hurt he should have made sure that this situation was safe for the child. Also, he killed their daughter, I can understand wanting to prosecute someone for doing that.

I would have to agree with the court ruling, as negligent homicide seems to be an appropriate punishment for the grandfather. Though he may have been a lovely man and father who just made a careless mistake, his actions resulted in the loss of life, which is both precious and irreplaceable. Further, as his actions were unintentional, his punishment is just, as negligent homicide entails "recklessness". One part of his ruling that may cause disagreement though is that negligent homicide involves a violent act, and it would be hard to conclude that the grandfather's actions were violent in any way.

This man should be prosecuted for negligent homicide however I don't think a prison sentence would be a just punishment. I am sure that the Judge in the case would be reasonable in the sentencing of this man. For a tragic incident like this it is often best that the court try and be as sensitive as possible and not be extreme in its judgment.

I think the grandfather should be prosecuted. Although I feel bad for him, it’s still his fault, and he should still be punished. Considering it’s an accident, I’m sure the judge would cut him some slack.

I think the grandfather is in the wrong here. Due to him not paying attention he caused the death of his grandson. He will most likely not be punished harshly due to the Grandfather obviously feeling terrible about this tragic mistake that he made.

I definitely agree with Brandon. Is it a terrible incident? Yes. Was he a loved one of the family? Yes. However, one doesn’t have to have intention to commit a crime. That is why it is called negligent homicide. Even though it was an accident, it resulted in a death. Therefore, he should be prosecuted, just as one would if they accidentally hit someone with their car and killed them. Just because we feel bad and it is a family member doing this act, doesn’t mean he should be off the hook.
